You may be able to get free family law advice. The Government funds some lawyers (Trudy is one of those lawyers) to provide one off advice about your family law situation. If you qualify you will receive advice and information about how to resolve your family law dispute.

Legal Aid – Cost of a lawyer

Legal costs can be off putting and unaffordable for many people. You may be eligible for legal aid. Trudy has more than 10 years of experience as a legal aid provider and can help you to complete the legal aid form. You may need to provide proof or your income and any debts.

Generally, Legal Aid will consider your income, your outgoings, the number of children you support and whether you have a partner and what assets you own, for example a house, car or savings. If you are receiving a benefit you are most likely to be eligible for legal aid.

If you are not eligible for legal aid Trudy is able to provide an estimate of the costs for work so that you will know in advance what your legal fees are likely to be.

Frequently asked questions

Do I need a lawyer?

You may not want to instruct a lawyer but it may be a good idea to speak with one so you can decide how serious the issues are and get advice on how the Court is likely to deal with your family situation.

Alternatively, you can get advice about reaching your own agreement without the help of lawyers or the Family Court through Family Dispute Resolution - Mediation.

I’ve heard that a lawyer might be appointed for my children.
What does this mean?

Sometimes a lawyer is appointed for your child or children in Family Court proceedings. That lawyer is there to obtain the wishes or views of the child/children and to put those views across to the Court.

I have had a problem with drugs and alcohol, but I still want to see my children – can you help me?

Yes. You can expect Trudy to give you advice about suitable contact arrangements and conditions and for a referral to a suitable counsellor or program provider who can assist you.

Can I get free family Law advice?

In some cases yes, you can get advice that is paid for by legal aid or the Ministry of Justice.

How long does it take to apply to the Family Court for orders?

Trudy can usually file applications in the Family Court within 24 hours and in some cases on the same day as you provide Trudy with instructions.

I look after the children full time, do I still have to get agreement from the other parent about moving town?

Yes, in most cases you do. There are some exceptions.

Can I still live with my partner if a protection order is in place?
